Shasta County Suspended Driver's License Defense Lawyer
At the office of attorney Douglas L. Gardner, I bring more than 25 years of experience in criminal law to people in Northern California. A former senior deputy district attorney, I know how the state prepares criminal prosecutions and can help you formulate a strategy to protect your rights.
I take a straightforward approach, always advising you of any developments in your case and giving you a realistic assessment of your options, as well as your likelihood of success. I will listen carefully to you questions and concerns so that I can identify solutions that meet your needs.
I provide a free initial consultation to anyone charged with DUI or facing a Department of Motor Vehicles (DMV) hearing. Contact me online or call my office at 530-410-0648 or toll free at 866-912-8977 for an appointment.
Protecting Your Rights in DMV Hearings
After a DUI arrest, you must file a request for an administrative hearing with the DMV. If you do not, your license will automatically be suspended for a certain amount of time determined by the DMV. Without proper representation, you could lose your right to drive for up to four months. As your lawyer, I will handle all matters related to the DMV hearing, filing any required documentation and acting as your advocate throughout the proceedings.
When I appear on your behalf at a DMV hearing, I will gather and present all evidence to demonstrate your right to retain your driving privileges. For example, I have often been successful in using scientific research, including alcohol absorption or burn off rates, to demonstrate that your blood alcohol content (BAC) was in fact below .08 (the legal limit) at the time of arrest.
Because of my considerable experience in DMV proceedings, I know how they are conducted and what to expect. I will carefully review the information contained in a police report, as I know that most hearing officers are former police officers who will give priority to police reports over eyewitness testimony.
